Since we succeeded in developing CO2 gel mask for the first time in the world in 1997, we have obtained the following seven patents. We are striving to remove imitations by filing lawsuits against manufacturers and distributors of illegal products.

CO2MASK Since official and genuine CO2 Gel Masks produced and marketed under our charge have the approval mark shown at left, please note that you should check whether the products you will deal in have this mark. This mark guarantees the safe and secure quality of the products, which are not imitations or products of poor quality.

Additionally, please note that, if a company using our patented inventions holds patents for particular ingredients of the CO2 Gel Mask that the company manufactures, this does not provide any reasons for denying that company’s violation of our patents.

Although various imitations of our CO2 Gel Mask are found in the market, we are, as an authentic leading company in the invention of CO2 masks, determined to take resolute action, including filing of lawsuits, against manufacturers and distributers of imitations.

Report on the High Court Judgement on the Patent Rights Infringement Lawsuit Pertaining to the Patents for Carbonic Acid Packs(Jan 8, 2014)

Our company owns the rights to Patent No. 4659980 on the invention of “Composition Substances Containing Carbon Dioxide” pertaining to carbonic acid packs. We have filed a lawsuit for the infringement of patent rights (Osaka District Court 2011 (xiii) No. 4836, High Court for Intellectual Property 2013 (xx) No. 10016) against KBC Co., Ltd (old trade name: Kalu Co., Ltd.). On this occasion, judgment has been passed in the High Court for Intellectual Property to fully recognize all claims on our part. A summary of the judgment is given below.

In the High Court for Intellectual Property, the key point at issue has been the claim by the appellant (defendant) on whether there are valid grounds for our lawsuit. However, the judgment has dismissed all such claims and demonstrated the validity of our patent rights. With regards to the enforcement actions prior to the grant of the patent in this matter, an extremely high tariff rate of 10% of the revenue has been ordered to be paid as compensation. This point also serves to demonstrate the high value that has been accorded to our patent.
So far, we have taken resolute measures against products similar to our carbonic acid packs. Going forward, we will continue to deal resolutely with manufacturers, sellers and aesthetic salons using these products, including the filing of legal claims. We sincerely request that all such parties stop dealing in such similar products.

Report on the Settlement of the Temporary Injunction Against Favorina(Jun 27, 2013)

Our company has filed a lawsuit against Favorina Co., Ltd. (1-1-1, Yakuin, Chuo-ku, Fukuoka-shi) to seek a temporary injunction (Osaka District Court 2012 (xv) No. 20018) to stop the manufacture and sales of carbonic acid gel packs by the same company. On this occasion, we would like to report that a settlement has been reached with the said company.
Although the details of the settlement cannot be made public, a lump sum payment has been made in our favour as part of the settlement agreement. We therefore believe this settlement has served to demonstrate the due respect that is owed to the existence of the patent owned by us.
A variety of similar products have appeared in the market for carbonic acid gel packs. Going forward, we will continue to deal resolutely with manufacturers and sellers dealing in these products, including the filing of legal claims.
Therefore we request that all such parties stop dealing in such similar products in future.

Report on the New Patent Granted for Carbonic Acid Packs (Mar 23, 2013)

Our company owns the patent rights to Patent No. 4659980 (date of grant: Jan 7, 2011) and Patent No. 4912492 (date of grant: Jan 27, 2012) with regards to the invention of “Composition Substances Containing Carbon Dioxide” in carbonic acid packs. We have been enforcing our rights against parties who have infringed upon our patents, and on Dec 28 last year, a new patent (Patent No. 5164438) was granted to expand the scope of our rights.

 Currently, we consider that almost all the carbonic acid packs containing a combination of two agents that exist in the market come under the scope of rights of the patents concerned.

 As a leading company for carbonic acid packs, we resolve to take legal measures against companies which sell similar products. Going forward, we will continue to forcefully adopt actions to eliminate infringing products.

 So far, we have filed patent infringement lawsuits and applied for temporary measures against a total of 12 companies (including 8 directors of the defendant companies), and currently we are making preparations to file lawsuits against several other companies. In addition, we would also like to report that we have sent infringement warnings to more than 40 companies, the majority of which has either stopped the sales of the infringing products or reached a settlement with us by paying a settlement fee.

Report on the Judgment of the Patent Rights Infringement Lawsuit Pertaining to the Patent for Carbonic Acid Packs (Jan 10, 2013)

Our company owns the patent rights to Patent No. 4659980 with regards to the invention of “Composition Substances Containing Carbon Dioxide” in carbonic acid packs. We have filed a patent rights infringement lawsuit (Osaka District Court 2011 (xiii) No. 4836) against the defendants KBC Co., Ltd. (old trade name: Kalu Co., Ltd.), Salea Kaken Co., Ltd. and Thanks Seiyaku Co., Ltd. On this day, the court has ruled in favour of the patent right infringement and granted an injunction against the manufacture and sales of the defendants’ products and ordered that damages and compensation totalling 288,591,466 yen be paid.

Invalid Trial Judgment regarding the Patent for Carbonic Acid Gel Pack(May 24, 2012)

Our company owns the patent rights to Patent No. 4659980 with regards to the invention of “Composition Substances Containing Carbon Dioxide” in carbonic acid gel packs. We have initiated legal action to enforce our rights against Kalu Co., Ltd. and other parties selling the products of the same party who have infringed upon this patent (with regards to this lawsuit, the court has ruled in favour of the infringement of patent rights and currently, a trial is underway to discuss damages). As a countermeasure against this lawsuit, Kaku Co., Ltd. has filed a claim to declare the trial judgment invalid (Invalid 2011-800244). However, the claim by Kalu Co., Ltd. has been dismissed and a trial decision has been passed to admit the validity of our patent.

A variety of similar products have appeared in the market for carbonic acid gel packs. Going forward, we will continue to enforce our patent rights and work towards the elimination of such similar products.

Therefore we request that all such parties stop dealing in products similar to our carbonic gel packs in future.

Report on the Temporary Measure Granted with Regards to the Patent for Carbonic Acid Gel Pack(Jan 26, 2012)

Our company owns the patent rights to Patent No. 4659980 with regards to the invention of “Composition Substances Containing Carbon Dioxide” in carbonic acid gel packs. We have initiated legal action to enforce our rights against parties that have infringed upon this patent. With regards to our application for a temporary injunction against infringement of our patent rights that we have filed in the Osaka District Court (Osaka District Court 26th Civil Law Court 2011 (xv) No. 20014), the court has reached a decision and granted a temporary injunction against the infringing products on Jan 25, 2012.

Case Summary
This case involves the application for a temporary injunction to stop the sales of the above-mentioned products based on Patent No. 4659980 (Viscous Composition Substances Containing Carbon Dioxide) owned by our company. The court has admitted the validity of the patent rights infringement and granted an injunction against the debtor’s products and appointed a court execution officer to that effect.

 In addition to the temporary injunction above, we have also filed a lawsuit against Kalu Co., Ltd. and others, to stop the manufacture and sales of the above-mentioned products and to seek total damages of 376.5 million yen as compensation (Osaka District Court 2011 (xiii) No. 4836). Currently, this lawsuit is proceeding to trial with regards to the amount of damages and compensation to be paid.

 A variety of similar products have appeared in the market for carbonic acid gel packs. However, the sales of products in violation of our patent rights have decreased due partly to the effect of the temporary injunction mentioned above. Going forward, we will continue to deal resolutely with manufacturers, sellers and aesthetic salons using these products, including the filing of legal claims. Therefore, we sincerely request that all such parties stop dealing in such similar products.
